    Ordering Takeout in New Jersey? Major Restaurant Rule Changes Begin August 1

    New Jersey diners will notice fewer utensils and condiment packets with takeout orders from August 1 as the statewide Skip the Stuff law changes restaurant service.

    Takeout Orders Across New Jersey Are About to Change

    Ordering food from your favourites New Jersey restaurant will soon come with a noticeable difference.

    Starting August 1, restaurants, cafés, diners, coffee shops, food trucks and delivery services across the state will no longer automatically include single-use plastic utensils and condiment packets with takeout or delivery orders. Customers will need to request these items under New Jersey’s new “Skip the Stuff” law.

    Customers Must Now Ask for Disposable Items

    Whether ordering in person, over the phone, online or through delivery apps such as DoorDash and Uber Eats, disposable forks, knives, spoons, napkins and condiment packets will no longer be included by default.

    Instead, ordering systems will automatically select “no utensils or condiments,” allowing customers to opt in only if they actually need them. Restaurants will also provide only the specific disposable items requested rather than handing out extras.

    New Law Targets Plastic Waste

    State officials say the legislation is designed to reduce unnecessary plastic waste while encouraging more environmentally friendly dining habits.

    Millions of disposable utensils and condiment packets are thrown away every year, with many never being used because customers already have cutlery available at home. Officials believe the change will significantly reduce waste across the state.

    Dine-In Service Will Also See Changes

    The new rules extend beyond takeaway and delivery orders.

    Full-service restaurants with seating for ten or more customers must now provide reusable, washable utensils for diners eating inside. Plastic straws and other disposable items will still be available, but only when customers specifically request them.

    Restaurants Have Been Preparing in Advance

    Many restaurant operators have already updated their ordering systems ahead of the law taking effect.

    Major chains, including Texas Roadhouse and Olive Garden, have confirmed that their online ordering platforms already allow customers to request disposable utensils separately, helping businesses comply without disrupting service.

    Some Businesses and Institutions Are Exempt

    Not every food service provider will be affected by the new requirements.

    The law exempts K-12 schools, healthcare facilities and correctional institutions. Manufacturer-packaged food products that already include disposable utensils are also excluded from the new rules.

    Businesses Could Face Financial Penalties

    Companies that fail to follow the law may receive warnings and financial penalties.

    Authorities will issue an initial warning for a first violation, while repeated offences could result in escalating fines. Revenue collected from penalties will help support New Jersey’s Clean Communities Program.

    A Small Change With a Long-Term Goal

    Although customers may notice only a small adjustment when ordering food, officials believe the long-term environmental benefits could be significant.

    By requesting utensils and condiment packets only when necessary, New Jersey residents can help reduce unnecessary plastic waste while supporting the state’s broader sustainability efforts.
