A Florida father has been indicted on a first-degree murder charge after investigators said new evidence linked him to the 2024 death of his six-month-old son.

What began as a child abuse investigation has now become a murder case that has shocked many across Florida. Nearly two years after a six-month-old baby died from devastating injuries, prosecutors have accused the child’s father of first-degree murder, saying newly uncovered evidence paints a far more disturbing picture of the infant’s final months.
Investigators allege that James Westervelt, 38, repeatedly mistreated his young son before the child’s death in August 2024. Among the allegations is an incident in which detectives say Westervelt used a leaf blower on the infant because he believed it was amusing. Authorities say that episode became part of a broader investigation into the baby’s treatment inside the home.
Infant rushed to hospital after medical emergency
The investigation began when emergency responders were called to the family’s Marion County home after reports that the six-month-old baby had become unresponsive.
The infant was taken to a nearby hospital, where doctors placed him on life support. Despite medical efforts, the child died several days later. A medical examination later concluded that the baby suffered fatal head injuries consistent with abusive trauma, prompting detectives to launch an extensive criminal investigation.
Investigators uncovered additional evidence
As the investigation continued, detectives reviewed electronic evidence and interviewed family members and other witnesses. During that process, they recovered video that allegedly showed Westervelt blowing air from a leaf blower toward the infant during an earlier incident when the baby was only about two months old.
According to investigators, Westervelt later acknowledged the incident during questioning and said he thought it was funny. While authorities have not identified the leaf blower incident as the direct cause of the child’s death, they say it helped establish a pattern of abusive behavior that became important to the case.
Prosecutors upgraded the charges
Westervelt was initially arrested on child abuse charges connected to the investigation. However, detectives continued gathering evidence and conducted additional interviews after he was taken into custody.
Authorities say some of his later statements conflicted with earlier accounts, leading prosecutors to present the case to a grand jury. The grand jury returned an indictment charging him with first-degree murder in connection with his son’s death.

Court records show Westervelt remains in custody while the criminal case proceeds through the Florida court system. He is expected to appear in court in the coming weeks to answer the upgraded charge.
He also faces separate drug possession charges that are unrelated to the infant death investigation. Those allegations will be handled independently from the murder case.
